To prohibit the Secretary of Health and Human Services from finalizing a rule proposed by the Centers for Medicare & Medicaid Services with respect to the determination of whether an individual is lawfully present in the United States for purposes of the eligibility of such individual for enrollment in certain health insurance programs.

This bill prohibits the Secretary of Health and Human Services from finalizing, implementing, or enforcing a proposed rule by the Centers for Medicare & Medicaid Services that would clarify eligibility determinations regarding lawful presence in the United States for enrollment in qualified health plans, advance premium tax credits, cost-sharing reductions, basic health programs, and certain Medicaid and Children's Health Insurance Program (CHIP) benefits. The bill blocks any substantially similar rule from being finalized as well.
