Summary
This bill provides an antitrust exemption for state-licensed real estate brokers, their salespersons, and related trade associations from federal antitrust laws, but only to the extent that their activities are not already regulated by state law. The bill declares that state regulation and taxation of real estate brokerage is in the public interest and voids all prior federal laws, rules, or settlements relating to real estate brokers. Federal antitrust laws (Sherman Act, Clayton Act, and Federal Trade Commission Act) would apply only to real estate brokerage activities not covered by state regulation.
