This bill amends federal patent law to eliminate judicial exceptions to patent eligibility and establish a new statutory framework for determining which inventions qualify for patent protection. Under the bill, any useful process, machine, manufacture, or composition of matter would be eligible for a patent, except for five categories: standalone mathematical formulas, mental processes performed solely in the human mind, unmodified human genes, unmodified natural materials, and substantially economic or business processes (unless they require a machine or manufacture to perform). The bill also clarifies that patent eligibility determinations must consider the claimed invention as a whole and without regard to whether elements are known or conventional.
