The Vote Without Fear Act creates a federal prohibition on unauthorized firearm possession at Federal election sites—defined as buildings or parts thereof where election administration, ballot processing, or ballot counting occurs for federal elections. The bill makes it unlawful to knowingly possess or cause a firearm to be present in or within 100 yards of an entrance to such a site, with exceptions for law enforcement officers on duty, firearms secured in vehicles without removal or brandishing, and lawful possession in residences or businesses. Violations carry penalties of up to one year imprisonment and/or fines; possession with intent to use a firearm in a crime carries up to five years imprisonment; and homicide committed during such violations is prosecuted under existing murder and manslaughter statutes.
