This bill amends the federal sentencing guidelines for human smuggling offenses to increase penalties based on the number of people smuggled and any resulting injuries or deaths. The bill establishes a tiered system that adds 2 to 10 offense levels depending on whether 2 to 50+ unlawful aliens were smuggled, and adds 2 to 10 levels per person for bodily injury, serious bodily injury, permanent injury, or death. The cumulative offense level increases are capped at level 29 (or level 38 if certain aggravating factors apply).
