Under current law, biosimilars can be negotiated after 9 months of market exclusivity; this bill extends that period to 2 years and creates an automatic delay if a manufacturer publicly discloses that a biosimilar application has been accepted for FDA review or is expected to launch within 2 years. If the biosimilar is not marketed within the delay period, the original drug's manufacturer must pay a rebate to Medicare.
