The Births in Custody Reporting Act requires states to report anonymized quarterly data to the Attorney General about pregnant inmates and those who give birth while incarcerated in state and local correctional facilities. States must report information including the number of pregnant inmates, their race and ethnicity, pregnancy outcomes, use of restraints, prenatal and postpartum medical care, and placement in restrictive housing. States that fail to comply after a 120-day grace period (extendable by the Attorney General) may lose up to 10 percent of certain federal law enforcement funding, with reallocated funds going to compliant states. The Attorney General must study the reported data and submit findings to Congress within two years.
