The Patient Safety and Whistleblower Protections Act establishes federal protections for health care practitioners who raise concerns about patient safety, quality of care, or staffing practices. The bill prohibits retaliation by health care facilities against practitioners who communicate safety concerns internally, to government officials, or to patient safety organizations, and creates a rebuttable presumption that adverse actions within 180 days of such communications constitute retaliation. It authorizes individual and class action lawsuits with damages up to $1 million in individual cases and establishes Medicare participation requirements for facilities to have mechanisms for anonymous reporting and investigation of patient safety concerns.
