We write to request that the Government Accountability Office (GAO) conduct a review of manufacturer prescription drug coupons and their impact on drug utilization and the commercial insurance market.
Pharmaceutical companies often offer coupons to privately insured patients in order to provide discounts on brand-name drugs even when lower-cost generic alternatives are available. While these coupons often lower or eliminate the patient’s copays in the short-term, in the long-term they could lead to the patient unnecessarily paying more for the brand-name drug. Brand-name drug coupons can also lead to uncertainty about a patient’s out-of-pocket costs from month-to-month, since pharmaceutical companies can change their coupon programs and patient eligibility rules for those programs at any time. We are concerned that these coupons can enable drug manufacturers and pharmacy benefit managers to maintain high list prices and drive up costs for all patients through higher insurance premiums.
Drug companies are often able to keep their drug prices outrageously high by setting their own list prices, and then offering copay coupons in order to help some patients afford those high prices. Companies also use drug coupons to increase drug sales for a particular brand-name drug and to steer patients away from lower-cost generics. In fact, pharmaceutical companies earn as much as $4 more in drug sales for every $1 that they spend on prescription drug coupons. Manufacturers are banned from offering these coupons to patients who are covered by Medicare and Medicaid under anti-kickback laws, due to the fact that the coupons encourage doctors to prescribe more expensive drugs under public payers when cheaper versions are available.
One reason why patients may use manufacturer prescription drug coupons is because it is difficult for the patient to determine which prescription drug option will be most affordable. Many patients do not know what they are expected to pay for a drug when they go to the pharmacy counter. One way that patients can get accurate and clinically appropriate information about their most affordable medication option is through an online real-time benefit tool, which shows providers and pharmacists real-time drug cost information, coverage information, and alternative medication options within electronic health record systems. The Consolidated Appropriations Act of 2021 required Medicare Part D plans to increase the use of these real-time benefit tools, and we seek information on how these tools are being used in private insurance plans as well as Medicare Part D.
To better understand the impact of prescription drug coupons and the availability of real-time benefit tools in the commercial insurance market, we request that GAO provide responses to the following questions:
1. Describe, to the extent that reliable data are available, the availability and characteristics of manufacturer prescription drug coupons for the highest expenditure prescription drugs in the commercial market. Examples of such characteristics could include whether the drug is single source or has generic equivalent or a biosimilar, whether the drug has a therapeutic substitute, the dollar value of the coupon, who is eligible to use the coupon, and the terms and conditions for the coupon.
2. Describe, based on evidence from published studies, how manufacturer prescription drug coupons can affect the use of a drug.
3. Describe how plan sponsors in the commercial market have responded to the use of manufacturer prescription drug coupons for the highest expenditure prescription drugs, including how coupons are considered in benefit design decisions and patient premium and cost-sharing calculations.
4. Describe the extent to which prescribers, patients, and pharmacists are able to access to electronic real-time benefit tools in the commercial health insurance market.

During the trip, which comes amid concerns about the lawlessness of the Trump Administration’s immigration enforcement efforts, Senator Hassan also inspected conditions at an ICE detention facility.
“We need to strengthen security at our Southern border to stop drug trafficking and ensure that we have an immigration system that is orderly and consistent with our values,” said Senator Hassan. “I was grateful to meet with federal law enforcement officials who are working to secure our southern border and intercept illegal drugs. WASHINGTON — U.S. Senator Maggie Hassan (D-NH) released the following statement after this morning’s vote to fund the Transportation Security Agency (TSA), the Federal Emergency Management Agency (FEMA), and other Department of Homeland Security agencies while continuing to press for common-sense reforms to ICE:
“Granite Staters count on their government to work for them and to keep them safe. The chaos at our airports is unacceptable — and so is the conduct of masked federal immigration agents, which resulted in the killings of Renee Good and Alex Pretti in Minneapolis.
“For several weeks, I’ve supported efforts to fund TSA, FEMA, the Coast Guard, and other agencies at the Department of Homeland Security while Congress negotiates reforms to ICE — but President Trump refused. Thankfully, the President finally relented, and Granite Staters can breathe a sigh of relief now that the Senate passed this funding on a bipartisan basis.
“There is still significant work ahead. People in New Hampshire and across the country are demanding common-sense reforms to ICE, which would bring the agency in line with standards that local law enforcement officers are proud to meet every day. All Americans must continue to press for these reforms because the safety of our communities depends on it.”

WASHINGTON – U.S. Senator Maggie Hassan (D-NH), Ranking Member of the Joint Economic Committee, led a bipartisan Congressional hearing yesterday on ways to strengthen efforts to combat scams. The hearing included testimony from top leaders at the U.S. Department of Justice and the FBI, as well as representatives from AARP, Aspen Institute, and other entities. The hearing is part of Senator Hassan’s ongoing comprehensive push to combat scams.
Throughout the hearing, Senator Hassan pressed federal officials on the fragmented approach to scams – which also leads to confusion among the general public about where to report scams. She secured several commitments from the federal agency leaders to help improve coordination with state and local law enforcement, and to make it easier for people to report scams and get help.
“One of the great frustrations I hear on the ground is there are any number of places to report [scams],” said Senator Hassan at the hearing. “I’m working with Senator Rick Scott on a bipartisan bill that…would create a central secure website for Americans to report scams and get assistance, as well as a comprehensive federal strategy to prevent scams...and hold scammers accountable to the fullest extent of the law.”
Senator Hassan secured commitments from Gregory Heeb, Deputy Assistant Director of the Criminal Division at the FBI and Lois Greisman, the Associate Director of the Division of Marketing Practices at the Federal Trade Commission, to work with her office to simplify the scam reporting process for all Americans. “Senator, yes, absolutely. It is confusing,” responded Mr. Heeb. Ms. Greisman added, “Yes, of course, we commit to making it easier for consumers to report.”
Senator Hassan also highlighted the recent experience of a constituent from Derry and the difficulty that he has encountered in getting help. After his mother was scammed out of $80,000 by fraudsters who impersonated the FBI over the phone, he compiled case details and evidence for law enforcement, including the FBI, and his mother’s bank.
“But he’s still struggling to get help. He’s also unsure whether federal authorities have taken any action,” Senator Hassan said. Later in the hearing, Senator Hassan secured a commitment from the FBI to help this constituent, asking, “Can you commit to working with my office and reaching out to this constituent this week?” Mr. Heeb responded, “Yes, we can, Senator...I’ll take care of that.”
In addition, Senator Hassan raised concerns about the lack of coordination between state and local law enforcement and federal efforts, including the Scam Center Strike Force, a multi-agency task force investigating scam activity in Southeast Asia. “State and local law enforcement…are often the first point of contact when victims report a scam. Yet, New Hampshire law enforcement officers we reached out to recently weren’t even aware that the [Scam Center] Strike Force exists,” said Senator Hassan. “As important as the work you’re doing to go after the overall criminal organizations, we have to have coordination on the state and local level too.” Karen Seifert, Director of the Scam Center Strike Force at the U.S. Attorney’s Office of the District of Columbia, agreed that “absolutely” she will engage further with Senator Hassan’s office on this, while acknowledging that “we haven’t had that pathway so far.”
During the hearing’s second panel of witnesses, Senator Hassan talked with experts from AARP, the Aspen Institute, and the Government Accountability Office about her push to strengthen federal scams coordination and develop a centralized portal for Americans to report scams – and how that might help address the challenges that they have seen Americans face. Senator Hassan also discussed with the experts the importance of facilitating real-time information sharing between the private and public sectors as an important tool when combatting scams.
