Proposing an amendment to the Constitution of the United States relating to a national referendum process.

This joint resolution proposes a constitutional amendment creating a national referendum process through which citizens could enact federal laws or repeal existing ones, excluding war declarations, letters of marque and reprisal, rules on captures, calling forth the militia, appropriations, and constitutional amendments. Petitions would require signatures from at least 5 percent of voters in each of at least 25 states and a total of 5 percent nationally, collected within 18 months, with validation within 90 days and placement on the next ballot at least 120 days after certification. A measure receiving at least 60 percent of votes cast would take effect without presidential action, and Congress could not repeal or amend it for two years except by a two-thirds vote of each House. The amendment would take effect only if ratified by three-fourths of the states within seven years.
