Summary
The SAFER Act of 2026 amends the Immigration and Nationality Act to prohibit the Department of Homeland Security and Attorney General from granting asylum to individuals who have returned to their country of nationality or last habitual residence. The bill also provides that aliens who have already been granted asylum and subsequently return to their country of concern shall have their asylum status terminated and become subject to deportation. The bill includes narrow exceptions allowing the Secretary of Homeland Security or Attorney General to waive these prohibitions on a case-by-case basis if the President certifies travel is for national security purposes or the Secretary of State certifies the country has undergone a legitimate transfer of power.
