Summary
This bill amends the Administrative Procedure Act to establish special rules for certain agency adjudications. It allows defendants to file a demurrer that triggers automatic dismissal of the adjudication, after which the agency has 90 days to file a civil action in district court instead. Defendants in such civil actions would have the right to a jury trial and could assert a defense that an alleged violation was reasonable under the circumstances. The bill exempts immigration, national security, tax, bankruptcy, patent, and federal benefit matters from these rules.
