This bill amends the Employee Retirement Income Security Act of 1974 to allow health marketplace pools to be treated as employers for purposes of offering group health plans and group health insurance coverage. Health marketplace pools meeting specified requirements—including being formed in good faith to offer group coverage without conditioning membership on health status—would be able to offer coverage to their members and employees of member employers. The bill permits these pools to offer drug-only coverage and allows rates to vary by individual, subject to existing nondiscrimination rules.
