Summary
The bill would require any person that uses a training dataset to train or release a generative AI model to file a notice with the Register of Copyrights. The notice must include a sufficiently detailed summary of each registered copyrighted work in the dataset and, if the dataset is publicly available online, its URL, filed at least 30 days before commercial use or release for new models (or within 30 days after Copyright Office regulations for existing models). The bill creates a private right of action allowing copyright owners to seek civil penalties of at least $5,000 per violation (capped at $2.5 million per year per person), injunctions, and attorney's fees, and requires the Register to maintain a public database of the notices.
