The American Protein Processing Modernization Act directs the Secretary of Agriculture to establish and publish food safety criteria for meat and poultry processing establishments to request approval for operating at alternate (faster) inspection rates. The Secretary must respond to such requests within 90 days, approving those that meet the criteria or denying them with written explanation; requests not answered within 90 days are automatically approved. Establishments already operating at alternate rates may continue doing so if they maintain effective process control. The Secretary may revoke approval if an establishment fails to meet food safety criteria, but must provide notice and a 180-day remediation period before revocation.
