The letter reads in part: “As you know, state-legal cannabis businesses have been denied ordinary business tax deductions and credits due to Section 280E, which prohibits any such deductions for expenditures related to controlled substances listed in Schedules I and II […]3 As a result of qualifying cannabis placement under Schedule III, Section 280E is no longer applicable to qualifying state-legal cannabis-related trades or businesses. This change materially alters the federal tax framework governing the cannabis industry.” The letter continues “As the National Taxpayer Advocate has previously noted, “the IRS must issue guidance and provide education in a proactive and timely manner. Timely guidance is vital to taxpayers, tax professionals, and industry, and it is just good tax administration.”4 The absence of clear and timely guidance for the cannabis industry will leave taxpayers uncertain as to how they can benefit from the tax code—whether it is the treatment of ordinary and necessary business deductions or accessing of tax credits. While we acknowledge that the Treasury has announced guidance is forthcoming 5, we urge swift and clear action. WASHINGTON D.C. – Congressman Steven Horsford (NV-04), Max Miller (OH-07), Suzan DelBene (WA-01), and Mike Carey (OH-15) today introduced bipartisan legislation The Digital Asset Protection, Accountability, Regulation, Innovation, Taxation, and Yields (PARITY) Act, which will bring much needed clarity, consistency, and common-sense guardrails to the taxation of digital asset activities. The PARITY Act creates a durable framework to address outdated and inconsistent tax rules surrounding digital assets, while ensuring innovation can continue responsibly. Specifically, the legislation focuses on creating administrable standards, preventing abuse, protecting consumers and investors, and ensuring the digital asset economy operates with transparency and accountability. “As digital assets continue to grow and evolve, Washington cannot afford to stay stuck in the past,” said Rep. Horsford.“Right now, the lack of clear rules creates uncertainty for consumers, investors, businesses, and regulators while leaving the system game-able for wealthy and sophisticated players. The PARITY Act establishes clear, durable, and administrable standards that strengthen investor protections, provide certainty to markets, and put strong guardrails in place to prevent abuse and manipulation. Innovation should not come at the expense of accountability or fairness. With clear rules of the road, everyday people not just large corporations and the ultra-wealthy can safely participate in these emerging technologies, build wealth, and help close the wealth gap.” “As America continues to lead the world in innovation, our tax code has failed to keep pace with the rapid growth of digital assets and modern financial technology,” said Congressman Miller. “The PARITY Act brings greater clarity, fairness, and common sense to the taxation of digital assets by modernizing outdated policies and creating a more workable framework for consumers, investors, and innovators alike. By establishing a more balanced and predictable tax framework, this legislation is a first step in fostering innovation here at home while ensuring the United States remains competitive in the global digital economy.” The Digital Asset PARITY Act would: Create a deemed-basis rule for regulated, dollar-pegged payment stablecoins to treat digital dollars used like cash as cash—reducing IRS administrability burdens and provide consumer-relief in routine transactions, and preventing misuse by trading or arbitrage activity. Provide clear tax certainty for foreign investors trading on U.S. digital asset platforms. Extend established securities-lending tax principles to qualifying digital asset loans. Apply significant anti-abuse provisions to digital assets that are already required for other similar activities, like wash-sale rules and constructive sales rules. Align the tax treatment of professional digital asset dealers and active traders with existing securities markets by permitting a mark-to-market election. Resolve the “phantom income” problem for miners and stakers by providing a clear, administrable election for when digital assets rewards are taxed. Modernize charitable contribution rules for digital assets. Clarify that passive, protocol-level staking by investment funds is not a trade or business. The pilgrimage comes as several Southern states continue efforts to redraw congressional districts in ways critics argue weaken the voting power of predominantly Black communities and reduce fair representation in Congress. “What we witnessed this weekend was the power of people coming together to confront injustice head on,” Rep. Horsford said. “The attacks we are seeing on Black voting power in the South should concern every single American because this is not just a Southern issue it is a threat to our democracy nationwide. We know what happens when communities are denied fair representation, and we cannot allow history to repeat itself. This pilgrimage was a reminder that the fight for voting rights did not end in Selma, and it does not end now. NORTH LAS VEGAS- Congressman Steven Horsford (NV-04) continued his “Congressman on the Job” series, a district-wide initiative where he steps directly into Nevada workplaces to experience firsthand the challenges facing workers, small businesses, and families across the Fourth District. As part of the series, Congressman Horsford joined My Garage Kitchen, a North Las Vegas small business founded in 2017 by owner Emmanuel “Manny,” who began cooking for friends and family out of his garage. Like many small businesses across Southern Nevada, My Garage Kitchen was forced to shut down during the COVID-19 pandemic. Through persistence and hard work, Manny was able to reopen and rebuild but is now facing a new wave of financial strain driven by rising costs. “Stories like Manny’s are exactly why I launched this series,” said Rep. Horsford. “He built his business from the ground up, fought through the pandemic, and did everything right to opener-open his doors. But now, small businesses like his are being hit by rising costs across the supply chain. That’s not right. My RELIEF Act is about making sure small businesses like his get the support they deserve, without delays or red tape.” The RELIEF Act would: • Require tariff refunds within 90 days of enactment • Apply to covered tariffs collected since January 1, 2025 • Eliminate the need for individual applications or formal protests "My RELIEF Act is straightforward: The Supreme Court said tariffs are illegal and the money paid needs to be returned. Horsford Works Alongside North Las Vegas Small Business Owner Impacted by Republican Healthcare Cuts

NORTH LAS VEGAS – Congressman Steven Horsford (NV-04) continued his “Congressman on the Job” series, a district-wide initiative where he steps directly into Nevada workplaces to experience firsthand the challenges facing workers, small businesses, and families across the Fourth District. As part of the series, Congressman Horsford joined TSP Bakery, a long-standing small business in the district, where he worked alongside staff to better understand the day-to-day realities of running a local business. He met with owner Kari Garcia, who shared the growing challenges of affording health care. Garcia explained that her premiums have increased by $180 compared to last year, a cost that is putting added pressure on her business and bottom line. "Kari isn't asking for a handout. She's asking for a fair shot.” Rep. Horsford explained “She built something from nothing, created jobs, and still lies awake wondering if one medical bill could wipe it all out. We fought to expand the ACA tax credits and we had it. But Republicans let it expire. They found the votes to hand billionaires a tax cut but couldn't find the will to protect people like Kari. That's not a budget decision that's a values decision. We're not done fighting." Since rejoining the House Ways and Means Committee, Congressman Horsford has been a leading voice in the fight to expand affordable coverage. During markup of the One Big Beautiful Bill Act, he introduced an amendment to permanently extend the Advanced Premium Tax Credit – relief which supported over 96,000 working Nevadans and their families during the 2025.
