Congressman McGarvey opposes the DHS funding bill, arguing that ICE has misused taxpayer funds and caused deaths of U.S. citizens and detainees, and should not receive additional funding without conditions or reforms.
Congressman McGarvey's statement opposes DHS funding without conditions or reforms, citing ICE misuse of taxpayer funds and deaths. The bill provides continuing appropriations for DHS through October 31, 2023, with some immigration-related restrictions but no explicit ICE reform conditions. His NO vote on passage aligns with his stated opposition to unconditional DHS funding. The score is not higher because the bill does include some immigration-related prohibitions on DHS fund use, which partially address his concerns about oversight, though he clearly viewed these as insufficient.

McGarvey's statement opposes funding ICE due to alleged abusive enforcement practices and lack of accountability. The Laken Riley Act expands ICE detention authority and creates state-level enforcement mechanisms, which would increase ICE's operational scope and resources—directly contrary to his stated position against funding the agency. His NO vote aligns with his opposition to expanding ICE's powers and funding.

Congressman McGarvey opposes funding for ICE through the DHS appropriations bill, arguing that the agency engages in abusive enforcement practices and operates with impunity.
Congressman McGarvey's statement opposes funding for ICE and criticizes the agency's enforcement practices. The bill is a continuing resolution that funds federal agencies including DHS/ICE through October 31, 2023, and includes provisions limiting asylum eligibility. His NO vote on passage is consistent with his stated opposition to funding ICE; however, the bill is an omnibus continuing resolution that funds many agencies and programs beyond ICE, so his vote reflects opposition to the overall package rather than a targeted statement on ICE funding alone.
Congressman McGarvey supports impeachment of DHS Secretary Kristi Noem, citing obstruction of Congress, violation of constitutional protections and due process in immigration enforcement, and misuse of federal funds for personal and agency benefit.
McGarvey's statement opposes aggressive immigration enforcement by DHS under Secretary Noem, citing constitutional violations, due process breaches, and misuse of federal authority. The Laken Riley Act mandates detention of non-citizens arrested for property crimes and authorizes state suits against the federal government over immigration enforcement decisions. McGarvey's NO vote on the bill aligns with his stated opposition to expansive immigration enforcement powers and constitutional violations—the bill would expand DHS detention authority and create new litigation mechanisms that could further entrench the enforcement practices he criticizes. The positions point in the same direction on the specific question of whether to expand immigration enforcement authority.

Congressman McGarvey supports impeachment of DHS Secretary Kristi Noem, citing obstruction of Congress, violation of constitutional protections and due process in immigration enforcement, and misuse of federal funds for personal and agency benefit.
McGarvey's statement opposes DHS Secretary Noem's leadership and specifically criticizes misuse of taxpayer funds for an ICE recruitment ad campaign ($200 million) that bypassed competitive bidding. His NO vote on the FY2024 DHS appropriations bill aligns with this position—voting against funding for DHS (which includes ICE) is consistent with opposing the agency's current direction and resource allocation. However, the appropriations bill is a broad funding measure that covers multiple DHS components and functions beyond the specific misconduct allegations in the impeachment statement, creating some ambiguity about whether the vote reflects opposition to DHS funding generally or to specific provisions.
Congressman McGarvey opposes funding for ICE through the DHS appropriations bill, arguing that the agency engages in abusive enforcement practices and operates with impunity.
The statement and bill address related but distinct immigration enforcement questions. McGarvey's statement opposes ICE funding and enforcement practices broadly, citing abusive conduct. The bill restricts federal funds to sanctuary jurisdictions that don't cooperate with ICE detainers—a policy that would increase ICE's enforcement capacity by removing funding barriers to cooperation. McGarvey's NO vote aligns with his stated opposition to ICE funding, but the bill's specific mechanism (penalizing sanctuary policies) is not directly addressed in his statement. The shared topic is immigration enforcement, but the statement focuses on ICE conduct and funding levels, while the bill focuses on sanctuary jurisdiction compliance and federal funding conditions.
Congressman McGarvey supports impeachment of DHS Secretary Kristi Noem, citing obstruction of Congress, violation of constitutional protections and due process in immigration enforcement, and misuse of federal funds for personal and agency benefit.
Both the statement and bill address immigration enforcement, but they target different specific questions. McGarvey's statement opposes DHS Secretary Noem's immigration enforcement practices, citing constitutional violations, due process breaches, and misuse of federal authority. The Agent Raul Gonzalez Officer Safety Act creates new criminal penalties for fleeing law enforcement near the border—a measure that strengthens enforcement tools. McGarvey's NO vote aligns directionally with his stated opposition to aggressive immigration enforcement, but the bill does not address the obstruction of Congress, constitutional violations, or self-dealing that his impeachment statement emphasizes. The vote reflects opposition to a specific enforcement mechanism rather than a direct response to the Secretary's conduct.

Congressman Morgan McGarvey Responds to Trump's KY Rally: Trump is Coming Here to Lie | Congressman Morgan McGarvey of Kentucky's 3rd District
Position: The release criticizes the President's economic record and policies, asserting that household costs for housing, electricity, health insurance, and gasoline have risen in Kentucky since he took office, and calls on him to answer for these outcomes.
WASHINGTON, D.C. (October 16, 2026) – Today, Congressman Morgan McGarvey, the only Democrat in Kentucky’s congressional delegation, spoke with reporters ahead of Trump’s rally in Northern Kentucky tomorrow and called out the President’s planned visit to a state he won by 30 points to sell an economy Kentucky families already know is failing them.
New data shows the average household in Kentucky has paid more than $4,100 extra for everyday essentials since Trump took office.
“The President should have to answer for every lie he’s told over the last 2 years,” McGarvey said when asked about Trump’s visit. “Tell Kentuckians why we’re paying more for gas, why people’s health insurance is more expensive, why people’s groceries are more expensive. Everything is way more expensive because of him and his policies, and he should answer for what he’s done to people.”
The Cost of Trump’s Presidency in Kentucky
– $748 more on housing costs, such as rent and mortgage payments
– $190 more on electricity in Trump’s first year than in 2024
– $100s more on health insurance premiums and out-of-pocket costs after Trump’s Medicaid cuts
Kentuckians have collectively spent $2 billion more on gas…
…and each family has spent nearly $1,000 more on gas ($985) since the start of Trump’s war in Iran.

Congressman Morgan McGarvey on MS NOW: Kentucky Bourbon Caught in Crosshairs of Trump’s Trade War, Pro-Trump TV Ads with Taxpayer Money “It’s Awful” | Congressman Morgan McGarvey of Kentucky's 3rd District
Position: Congressman McGarvey criticizes Trump's trade war with Canada, arguing that Canadian boycotts and import bans are harming Kentucky bourbon sales and raising prices for U.S. consumers. He also argues that Medicaid and rural hospital cuts will harm Kentuckians and that federal taxpayer funds should not be used for pro-Trump television ads.
This morning, Congressman Morgan McGarvey (KY-03), Co-Chair of the Congressional Bourbon Caucus and Kentucky’s only Democrat in Congress, joined Ali Vitali to sound the alarm on Trump’s newest Canadian import ban and the Canadian boycotts and de facto trade bans still hammering Kentucky bourbon.
McGarvey has been a vocal critic of Trump’s trade war with Canada, which buys more Kentucky spirits than any other country, and warned that the bans will further damage the state’s $9 billion signature industry, fuel U.S. inflation, and force higher prices on U.S. consumers.
On Kentuckians’ reaction to Trump’s trade war:
“What people here know is that sales are down, that Canada has taken bourbon off of the shelves. We send more liquor to Canada than any other country.
“They’re asking, ‘What is this President doing and why? This is a guy who said he was going to be an America-first President and he’s putting us last.’”
“We’re a state where over 400,000 people got health insurance for the very first time in 2014 with the Affordable Care Act. We have a lot of people who depend on Medicaid to be able to take their kids to the doctor.
“The Kentucky Hospital Association, this is not some flaming liberal group, has predicted that 35 rural hospitals here in Kentucky could close.
"People know what that means. They know that they’re gonna continue to get sick, continue to have heart attacks, kids will continue to have accidents, there will still be early labor, and when seconds count they will not be able to go get the healthcare they need because of what this President is doing.
“People want to pump the brakes on this Administration.”
On the White House using taxpayer funds on Pro-Trump television ads:
“What is the president doing with taxpayer money? It is crazy, and this is just another example of some of the stuff that Republicans shoved in that One Big Awful Bill that they passed, that the President's now using again to promote himself.
“People are tired of seeing his corruption. The money he’s making. What he’s doing for himself and his family and then what he’s doing to us and our families.”

Reps. McGarvey, Jayapal Demand Trump Administration Reverse Rule to Fast-Track ICE Detention and Deportation Proceedings for Asylum Seekers | Congressman Morgan McGarvey of Kentucky's 3rd District
Position: Representatives McGarvey and Jayapal, with 69 Democratic colleagues, call on DHS to withdraw a rule that lets asylum officers deny affirmative asylum cases without an interview and refer applicants to immigration court, and urge more asylum officers and USCIS resources instead.
WASHINGTON, D.C. (August 14, 2026) – Today, Representatives Morgan McGarvey (KY-03) and Pramila Jayapal (WA-07) led 69 Congressional Democrats in a letter to the Department of Homeland Security (DHS) calling on the Trump administration to withdraw its new rule allowing asylum officers to reject an affirmative asylum seeker’s case without an interview and refer him or her directly to immigration court for deportation proceedings.
The rule comes as ICE ramps up arrests of individuals at airports, including those with legal status or pending applications.
Last month Sarafinah Bukirwa, one of McGarvey’s constituents with a valid visa and active asylum application, was detained by ICE at Louisville’s Muhammad Ali International Airport.
“USCIS’s failure to adjudicate such applications in a timely manner is now being weaponized by ICE, which, in collaboration with the Transportation Security Administration (TSA), is arresting individuals as they attempt to fly domestically,” the Members wrote.
McGarvey and Jayapal argued eliminating these interviews – a standard practice since 1990 – will deny those arrested under the new DHS rule from receiving full and fair consideration of their case, especially for asylum seekers who’ve faced persecution and violence and for survivors of gender-based violence.
The Members also rejected the administration’s claim that the rule would help address the asylum backlog, arguing it simply moves cases a USCIS officer could have decided into immigration courts, which already have 2.3 million pending asylum cases and keeps asylum seekers waiting in ICE detention even longer.
Instead, they called for increasing the number of asylum officers and resources for USCIS to process applications faster.
“Given the fact that Congress has given the administration $240 billion for immigration enforcement, moves like this call into question the Department’s ability to deploy those additional resources responsibly,” the Members continued.
Congressman McGarvey Sends Letter to EPA Administrator Opposing Exemptions for Kentucky Chemical Plants in Neighborhoods Already Facing Elevated Air Pollution, Higher Risks of Cancer | Congressman Morgan McGarvey of Kentucky's 3rd District
Position: Opposes the administration's recent Clean Air Act exemptions allowing two Kentucky chemical plants to exceed toxic emission standards, and calls on EPA to reconsider the rollbacks given elevated cancer risk in nearby neighborhoods.
WASHINGTON, D.C. (August 10, 2026) – Today, Congressman Morgan McGarvey sent a letter to Environmental Protection Agency (EPA) Administrator Lee Zeldin to oppose the Trump administration’s recent exemptions for chemical plants to comply with air standards that limit toxic emissions. The announcement included two Kentucky facilities: Zeon Chemicals, a synthetic rubber manufacturer in Louisville, and Westlake, a vinyl manufacturer in Calvert City.
“Removing these limits on chemical emissions will directly harm my constituents, including in Louisville neighborhoods that have already for decades lived with the impacts of industrial pollution and contamination,” McGarvey wrote.
In the letter, the Congressman calls on EPA to reconsider the rollbacks and points to EPA’s own National Air Toxics Assessment, which concluded that Rubbertown’s proximity to industrial facilities that release carcinogens into the air and groundwater supply has resulted in an elevated exposure to pollution and higher risk of cancer and other health problems.
Last year, the administration granted a similar exemption to Bakelite Synthetics, a formaldehyde plant located 500 feet from homes in the Riverside Gardens neighborhood in Louisville, just 6 months after a chemical spill at the facility turned a creek in the Rubbertown neighborhood of Louisville red.
“EPA should not reward polluters with exemptions without any regard for the people who will live with the consequences,” McGarvey concluded. “This administration’s irresponsible deregulatory actions will inevitably harm Louisvillians. Every person has a right to breathable air and clean water. Residents in at-risk neighborhoods shouldn’t need to worry about those rights being rolled back for the sake of industry.”
The letter follows a series of letters by Rep. McGarvey’s office, probing incidents of chemical pollution in Louisville linked with adverse health effects and an association with cancer.

Congressman Morgan McGarvey on Release and Hospitalization of Sarafinah Bukirwa | Congressman Morgan McGarvey of Kentucky's 3rd District
Position: The release calls for the immediate release and prompt medical care of Sarafinah Bukirwa, who was detained by ICE, and criticizes the administration's immigration enforcement actions in communities.
WASHINGTON, D.C. (July 31, 2026) – Congressman Morgan McGarvey released the following statement after Sarafinah Bukirwa, who was detained by U.S. Immigration and Customs Enforcement (ICE) at Muhammad Ali International Airport in Louisville, was released from ICE custody and admitted to the hospital today:
“I’m so relieved Sarafinah is finally getting the care she needs and this nightmare is behind her, but so many families are still going through it. As long as this cruel administration continues its campaign of terror in our communities, we have to keep standing up for our neighbors.”
Rep. McGarvey has been working with family and advocates of Bukirwa since she was detained on July 22 and has called for her immediate release and prompt medical care.

Congressman Morgan McGarvey Demands Records from ICE on Constituent with Serious Medical Condition | Congressman Morgan McGarvey of Kentucky's 3rd District
Position: Congressman McGarvey demands ICE records on the detention of a Kentucky constituent with sickle cell disease, calls for her immediate release and prompt medical care, and states she entered legally with a pending asylum claim and no criminal charges.
WASHINGTON, D.C. (July 29, 2026) – Today, Congressman Morgan McGarvey sent an urgent Congressional inquiry and records request to a senior U.S. Immigration and Customs Enforcement (ICE) official demanding information related to the detention of Sarafinah Bukirwa, who was taken into custody by ICE at Muhammad Ali International Airport in Louisville.
Rep. McGarvey has been working with family and advocates of Bukirwa since she was detained on July 22 and has called for her immediate removal and prompt medical care.
Read the full letter to ICE below:
On July 22nd at the Louisville Muhammad Ali Airport, Sarafinah Bukirwa (“Ms. Bukirwa”), a resident of Kentucky’s 3rd Congressional District, was taken into custody by Immigration and Customs Enforcement at Muhammad Ali International Airport in Louisville, Kentucky and transported to the Grayson County Jail.
This detention is particularly troubling because Ms. Bukirwa entered the United States legally, has a valid work authorization, and a pending asylum claim. Furthermore, based on the information reviewed by my team, as well as the information made available to Ms. Bukirwa’s attorney, there are no criminal charges pending or resolved against Ms. Bukirwa.
Ms. Bukirwa is the executive director of Sarafinah Sickle Cell Society (SASCELL), an organization that works to provide lifesaving medical care, awareness programs, and support services for those with sickle cell disease throughout the world. She was on her way to address a conference in California when ICE agents grabbed her and took her to Grayson County.
Of immediate concern, Ms. Bukirwa herself has sickle cell disease and had all her necessary medication and doctor’s instructions regarding her condition at the time of her arrest.
Our office has received reports that, upon arrival at the Grayson County Jail, Ms. Bukirwa was denied medication for her sickle cell disease. We have also been told Ms. Bukirwa was hit by officers, and was stripped of her hijab and all clothes in the presence of male officers.
As such, I am requesting the following information and materials no later than 5:00 PM on
All body-worn-camera footage recorded during Ms. Bukirwa’s arrival, removal from the transport vehicle, entry into the Grayson County Detention Center, and intake or booking process.
All fixed-camera, handheld-camera, surveillance, audio, or other recordings depicting Ms. Bukirwa’s arrival, intake, booking, searches, medical screening, housing assignment, movement through the facility, or first night in custody.
All video and audio recordings from the housing unit, cell, holding area, medical unit, intake area, booking area, hallway, sally port, or other location in which Ms. Bukirwa was held during her first 48 hours in custody.
The complete intake and booking file, including property inventories, search records, classification assessments, housing determinations, photographs, fingerprints, screening forms, acknowledgment forms, and orientation materials.
The names, titles, employers, and identification numbers of all ICE, DHS, Grayson County, contractor, correctional, and medical personnel who participated in or were present for Ms. Bukirwa’s intake.
Copies of all logs documenting welfare checks, cell checks, rounds, meals, medication distribution, medical encounters, requests for assistance, and movements involving Ms. Bukirwa.
All incident reports and grievances filed with DHS (including the Ombudsman and OIG and any other relevant subagencies who have jurisdiction over these issues) regarding any officers involved in Mrs. Bukirwa’s intake process.
Any and all incident reports that DHS (including any subagencies who have jurisdiction over these issues) has received regarding Grayson County staff and medical facilities since March 2025.
For any requested record that ICE contends is held by the Grayson County Detention Center, a contractor, another DHS component, or another governmental entity, please:
identify the custodian and location of the record;
state whether ICE has the contractual, legal, or practical ability to obtain it;
immediately direct the custodian to preserve it; and
provide my office with the name and contact information of the appropriate official from whom the record may be obtained.
This is an urgent congressional inquiry involving the liberty, health, and safety of a constituent with a serious medical condition.

Rep. McGarvey Opposes Camp Ground Road Data Center in Letter to LG&E: Don’t Raise Louisville’s Rates to Pay for It | Congressman Morgan McGarvey of Kentucky's 3rd District
Position: Opposes the planned hyperscale data center on Camp Ground Road in Louisville and calls on LG&E to ensure the project does not raise electricity costs for existing ratepayers.
WASHINGTON, D.C. (July 9, 2026) – Today, Congressman Morgan McGarvey (KY-03) sent a letter to LG&E President John R. Crockett III, opposing the hyperscale data center planned for Camp Ground Road in Louisville and demanding Louisville families aren’t forced to pay for the development or expected surge in electricity demand.
Despite widespread community opposition, the Louisville Planning Commission fast-tracked site approval for construction of the data center in June 2025, and phase one of the project is expected to come online in October.
The single facility is expected to use 400 megawatts of power – a 63% increase in demand on the grid, or the equivalent of adding roughly 280,000 households. To meet the rising energy demand of hyperscale data centers, utility companies have ramped up operations.
McGarvey argues Kentuckians shouldn’t be forced to shoulder the long-lasting costs again. “We sacrificed miners, their families, and our land for the benefit of industry and have never been made whole,” he wrote. “We must not repeat the mistakes of the past and again gamble with our community’s long term economic and environmental health.”
In the letter, McGarvey points to the explosion in data center electricity use nationwide – citing a 267% increase in electricity prices over the past five years in areas with high concentrations of data centers – and warns that “the companies that own, develop, and profit from these data centers often do not pay for this increased usage or bear the costs of bringing necessary capacity online.”
“LG&E must ensure that this hyper-scale data construction and the development of infrastructure required to serve it do not increase costs for existing ratepayers,” McGarvey concluded.
The letter demands answers to a series of questions about how LG&E will protect existing customers, including:
What new infrastructure is required to serve the Camp Ground Road data center, how much will it cost, and who will pay for these upgrades?
What costs will be passed on to residential and small business ratepayers?
Will current customers face higher risks of outages?
Will the data center get priority over existing ratepayers during extreme heat or weather?

Congressman Morgan McGarvey Reacts to Supreme Court Ruling Allowing Trump to End Legal Protections for Haitians, Syrians | Congressman Morgan McGarvey of Kentucky's 3rd District
Position: Opposes the Supreme Court's ruling allowing the administration to end temporary legal protections for Haitian and Syrian migrants, and criticizes the administration's immigration enforcement approach and statements about the Haitian community.
WASHINGTON, D.C. (June 25, 2026) – Today, Congressman Morgan McGarvey released the following statement after the Supreme Court ruled in Mullin v. Doe to end legal protections for migrants fleeing violence and natural disaster in Haiti and Syria:
“This has nothing to do with legal status, and it never has.
“The Trump administration is going after immigrants with legal status just so they can deport more people — and apparently the Supreme Court is going to let them do it.
“If you still think this isn’t racist, look no further than what the president has said about the Haitian community.”

Congressman Morgan McGarvey on Supreme Court Trans Athlete Ruling | Congressman Morgan McGarvey of Kentucky's 3rd District
Position: The release criticizes the Supreme Court ruling allowing states to ban transgender students from youth sports teams and the Trump administration's treatment of transgender youth. It also criticizes Republican policies it says have increased Medicaid losses and threatened patient care in Louisville.
WASHINGTON, D.C. (June 30, 2026) – Today, Congressman Morgan McGarvey released the following statement after the Supreme Court ruled in West Virginia v. BPJ and Little v. Hecox to allow states to ban transgender students from playing on youth sports teams:
“The Trump administration has gone out of its way to make life even harder for a couple of kids in Kentucky who already have it hard enough. Meanwhile, 15,000 Kentuckians already lost Medicaid this year because of how much costs have gone up and more than a thousand patients at Lee Specialty Clinic in Louisville are worried about losing their care.
“Republicans are hoping they can distract us from the damage they’ve done to our communities, but we’re not going to let them.”

Congressman Morgan McGarvey on Supreme Court Birthright Citizenship Ruling | Congressman Morgan McGarvey of Kentucky's 3rd District
Position: The release welcomes the Supreme Court's ruling blocking the executive order that would end birthright citizenship and states that anyone born in the United States is a citizen. It also criticizes the administration's approach to immigrants' legal status.
WASHINGTON, D.C. (June 30, 2026) – Today, Congressman Morgan McGarvey released the following statement after the Supreme Court ruled in Trump v. Barbara to block President Trump's executive order ending birthright citizenship:
"If you’re born in the United States, you’re a citizen. Period. The Trump administration is going after the legal status of anyone they don’t deem worthy to live in this country, and the Supreme Court should’ve never entertained it for this long.”
