The BARK Act of 2025 provides liability protections for individuals, nonprofit organizations, and state and local governments that donate pet food and supplies in good faith. Donors and recipients are shielded from civil or criminal liability for defects in the donated products, provided the products are apparently fit and the donation is made in good faith; however, protections do not apply to cases involving gross negligence or intentional misconduct. The bill also allows donations of non-compliant pet food or supplies if the recipient is informed of the defect and agrees to recondition the items before distribution.
