Summary
This bill amends federal transportation law to establish penalties for freight brokers that contract with unsafe carriers. A freight broker would be liable for a civil penalty equal to 10 percent of contracted cargo value if it contracts with a carrier that has received 3 or more Department of Transportation violations in the preceding 5 years, or employs a driver with 3 or more such violations. Penalties collected would be deposited into the Highway Trust Fund for roadway safety projects. The bill also authorizes the Federal Motor Carrier Safety Administration to investigate freight brokers following fatal crashes involving their contracted carriers and to impose additional operating requirements if the broker acted with egregious disregard for safety.
