Summary
The bill adds a new subsection to Section 1862 of the Social Security Act that bars Medicare payments to any hospital or skilled nursing facility owned or controlled by a covered firm, defined as a private equity fund, a corporation owned or controlled by a private equity fund, or a real estate investment trust, or an affiliate of such a firm. Facilities already owned by such firms on the date of enactment would have a three-year grace period before the prohibition applies, and affected facilities would receive notice and a hearing before a violation is found. Covered firms that own or are affiliated with a violating facility would be jointly and severally liable for penalties or obligations the facility incurs, and 'control' is defined to include holding 10 percent or more of voting securities.
